Terms & Conditions

The rules for using this site, what happens to anything you send me, and how disputes get resolved if it ever comes to that.

Last updated: September 4, 2026

1. Acceptance of terms

This site (cristobaldupuis.com) is operated by Cristobal Dupuis. By browsing this site, using the incrementality calculator or any other tool on it, or submitting the contact form, you agree to these Terms & Conditions. If you do not agree, please do not use the site.

This site is aimed at businesses and professionals evaluating growth, marketing, or consulting work, not consumer retail transactions. If you are accessing it on behalf of a company, you confirm you have the authority to bind that company to these terms.

2. About this site

This is a personal and professional site: a portfolio, case studies, a free incrementality calculator, and a way to get in touch about consulting work. It does not require an account, does not process payments, and does not host a public comment section or forum.

3. Use of the site

Unless noted otherwise, all text, design, code, benchmarks, and other content on this site are owned by Cristobal Dupuis or used with permission, and are protected by copyright and other intellectual property laws. You may view, download, and print pages for personal, non-commercial reference. You may not reproduce, republish, resell, or create derivative works from this content, or the underlying frameworks and benchmarks, for commercial purposes without prior written permission.

You agree not to:

  • Use the site in any way that violates applicable law or infringes anyone’s rights.
  • Attempt to gain unauthorized access to the site, its infrastructure, or any connected systems.
  • Interfere with the site’s operation, including through scraping at scale, denial-of-service activity, or automated abuse of the contact form or calculator.
  • Introduce malware or other harmful code through the site.

4. Tools, calculators & content

The incrementality calculator, benchmark tables, case studies, and any other frameworks on this site are provided for general informational purposes only. They reflect one operator’s experience and judgment, not a guarantee of results, and are not financial, legal, tax, or investment advice.

Calculator outputs are only as accurate as the numbers you enter and the assumptions built into the model; they are directional, not audited financial figures. Case studies and results referenced on this site describe outcomes achieved in specific, past engagements and are not a promise of similar results for you or your business. Always apply your own judgment, and consult a qualified professional, before making material business decisions.

5. Content you submit

This site does not currently have public comments, reviews, or user profiles. The main way you can submit content is the contact form, and, separately, if you send a testimonial, quote, or project details for a case study.

Contact form

Anything you submit through the contact form (name, email, and message) is treated as a private message to me, sent via the third-party form processor described in Section 6. It is used only to respond to you and is not published or shared publicly.

Testimonials, quotes & other voluntary submissions

If you voluntarily send a testimonial, quote, review, or other content intended for publication (for example, feedback on working together), you grant me a non-exclusive, worldwide, royalty-free, perpetual license to use, edit for length or clarity, reproduce, and display that content on this site and in related marketing materials, with attribution to you unless you ask otherwise. You confirm that you have the right to submit that content and that it does not infringe anyone else’s rights or violate any confidentiality obligations you have to a third party.

I reserve the right, but have no obligation, to review, edit, decline, or remove any submitted content, including from the contact form, at my discretion, including content I believe is unlawful, abusive, spam, or otherwise inappropriate. If this site adds public comments or other user-generated content features in the future, this section will govern that content unless updated terms say otherwise.

6. Privacy & data

This section explains what data this site collects, why, and what happens to it.

What is collected

  • Contact form: the name, email address, and message you choose to submit. Sent directly to Formspree, a third-party form processing service, and delivered to my email inbox. This site does not store form submissions in its own database.
  • Analytics: standard usage data such as pages visited, referring site, approximate location (derived from IP address), device and browser type, and general engagement metrics, collected via Google Tag Manager / Google Analytics and Vercel Web Analytics.
  • Calculator inputs: figures you enter into the incrementality calculator stay in your browser for that session. They are not sent to me or stored server-side.

Cookies & tracking

Google Tag Manager and Google Analytics are not loaded until you accept them in the cookie banner shown on your first visit; if you reject or dismiss it, that script never runs and no analytics cookies are set. Once accepted, they may set cookies or similar identifiers in your browser to distinguish visitors and measure site usage. Vercel Web Analytics is designed to operate without cookies and runs regardless of your choice. You can change your choice anytime via “Cookie Preferences” in the footer, or block/delete cookies through your browser settings.

Third parties this data passes through

  • Formspree (contact form delivery): processes form submissions on my behalf.
  • Google (Tag Manager / Analytics): processes analytics and, depending on tags configured, may include advertising-related measurement.
  • Vercel (hosting and web analytics): hosts the site and provides aggregate, privacy-focused traffic analytics.

I do not sell your personal information, and I do not share contact form submissions with anyone other than the processors above needed to deliver them to me.

Retention

Contact form messages are kept in my email as long as reasonably needed to respond to you and for my own records, then deleted at my discretion. Analytics data is retained according to Google’s and Vercel’s respective standard retention windows.

Your rights

This site is operated out of Ontario, Canada, so the Personal Information Protection and Electronic Documents Act (PIPEDA) governs how I handle your data. Depending on where you live, you may also have rights under other laws (for example, the GDPR if you’re in the EU/UK, or applicable state privacy laws if you’re in the US) to access, correct, or request deletion of personal information I hold about you. To exercise any of these, email cristobal.dupuis@gmail.comand I’ll respond within a reasonable time.

Children

This site is not directed at children under 16, and I do not knowingly collect personal information from them.

7. Third-party links & services

This site links to third-party platforms (for example, LinkedIn, GitHub, and Formspree). I don’t control those sites and I’m not responsible for their content, availability, or privacy practices. Review their own terms and privacy policies before using them.

8. Disclaimer of warranties

This site and everything on it is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I don’t warrant that the site will be uninterrupted, error-free, or secure, or that any tool, calculator, or benchmark will be accurate or suitable for your specific situation.

9. Limitation of liability

To the fullest extent permitted by law, Cristobal Dupuis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of, or inability to use, this site or any content or tool on it, even if advised of the possibility of such damages. Where liability cannot be fully excluded, it is limited to CAD $100.

10. Indemnification

You agree to indemnify and hold harmless Cristobal Dupuis from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these terms, your misuse of the site, or content you submit that infringes or violates the rights of a third party.

11. Governing law & disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Binding arbitration

Any dispute, claim, or controversy arising out of or relating to these terms or your use of this site that cannot be resolved informally within 30 days of one party notifying the other in writing, will be resolved by final and binding arbitration in Toronto, Ontario, in English, before a single arbitrator, under the Arbitration Act, 1991 (Ontario), rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will proceed on an individual basis only; you and I each waive the right to bring or participate in a class, collective, or representative action.

You may opt out of this arbitration agreement by emailing cristobal.dupuis@gmail.com within 30 days of first using the site, stating your intent to opt out; if you do, disputes will instead be subject to the exclusive jurisdiction of the courts of Toronto, Ontario.

12. Changes to these terms

I may update these terms from time to time, for example as this site adds new tools or features. The “Last updated” date at the top reflects the most recent revision. Continued use of the site after changes take effect means you accept the updated terms.

13. Contact

Questions about these terms, or a data request? Email cristobal.dupuis@gmail.com.
